SimRuito Affiliate Program – Terms & Conditions

1. Introduction

Welcome to the SimRuito Affiliate Program.

These Terms & Conditions govern your participation in the affiliate marketing program operated by SimRuito (“SimRuito,” “we,” “us,” or “our”) through https://simruito.com.

By registering for, accessing, or participating in our Affiliate Program, you agree to these Terms & Conditions.

2. Eligibility and Enrollment

To participate in the SimRuito Affiliate Program, you must:

Provide accurate and complete registration information.

Be at least 18 years old, or the age of legal majority in your jurisdiction, whichever is higher.

Have a genuine online presence, such as a website, blog, YouTube channel, social media account, sim racing community, or other relevant marketing platform.

Comply with all applicable laws, regulations, advertising requirements, and these Terms & Conditions.

Receive approval from SimRuito where required by our affiliate system.

SimRuito reserves the right to approve or reject applications at its discretion and may request additional information to verify an affiliate’s identity, promotional channels, or eligibility.

3. Commission and Customer Discount

Approved affiliates may earn a commission for eligible purchases made through their assigned affiliate coupon code or other approved affiliate tracking method.

The standard benefits of the SimRuito Affiliate Program are:

Affiliate commission: 3% of eligible net product sales.

Customer discount: 5% off eligible purchases when the customer applies the affiliate’s assigned coupon code.

The customer discount is separate from the affiliate commission. The affiliate does not receive the customer’s 5% discount as commission.

Commission calculation

Unless otherwise specified in writing by SimRuito, commission is calculated on the product subtotal actually paid by the customer after discounts, excluding shipping charges, taxes, refunds, chargebacks, and cancelled or fraudulent orders.

For example, if an eligible order has a product subtotal of $100 after discounts and before shipping and taxes, the affiliate earns $3 in commission.

The 5% customer discount is subject to the coupon’s configuration, eligible products, applicable promotions, and any restrictions displayed at checkout.

SimRuito may change commission rates, discount amounts, or eligible products for future transactions by providing reasonable notice. Changes will not retroactively reduce commissions already approved for eligible orders.

4. Eligible Purchases and Attribution

A purchase may qualify for commission when:

The customer completes an eligible purchase using the affiliate’s assigned coupon code explicitly approved by SimRuito.

The order is successfully paid.

The order is not cancelled, refunded, charged back, fraudulent, or otherwise ineligible.

The affiliate has complied with these Terms & Conditions.

Affiliate attribution is determined by SimRuito’s affiliate tracking system and applicable program rules.

If a customer uses multiple affiliate links or coupon codes, commission attribution will follow the rules configured in our affiliate system. Unless expressly stated otherwise, only one affiliate may receive commission for a single order.

SimRuito cannot guarantee commission for purchases where tracking fails, a coupon is not applied, or the customer does not complete the required purchase process.

5. Commission Approval and Payments

Affiliate commissions are subject to verification and approval by SimRuito. Commissions generated from orders that are cancelled, refunded, charged back, fraudulent, or otherwise ineligible will not qualify for payment.

Payment Method

SimRuito currently pays affiliate commissions exclusively through PayPal. Affiliates are responsible for providing accurate PayPal account information and ensuring that their account can receive payments.

PayPal Fees and Charges

All PayPal transaction fees, transfer charges, currency conversion fees, and other fees imposed by PayPal in connection with affiliate commission payments shall be borne by the affiliate.

Any such fees deducted from or charged in connection with a payment are the affiliate’s responsibility. SimRuito is not responsible for reimbursing these fees.

The amount ultimately received by the affiliate may therefore be less than the commission payment initiated by SimRuito, depending on the applicable PayPal fees and currency conversion rates.

SimRuito does not guarantee payment through any alternative payment method.

Minimum Payout Threshold

Affiliates become eligible for a payout once their account balance reaches a minimum of US$100 in approved, payable commissions.

Pending commissions do not count toward the minimum payout threshold.

Payment Timing

SimRuito aims to initiate payments as soon as reasonably practicable after an affiliate reaches the US$100 minimum payout threshold, provided that the commissions have been approved and the affiliate’s PayPal details are valid.

Payment processing times may vary due to verification requirements, payment processing delays, technical issues, or other circumstances beyond SimRuito’s reasonable control.

Reaching the minimum payout threshold does not guarantee an immediate payment.

Refunds and Commission Adjustments

If a commission has already been paid on an order that is subsequently refunded, cancelled, charged back, or determined to be fraudulent, SimRuito may reverse the commission or deduct the amount from future commissions, subject to applicable law.

SimRuito may temporarily withhold payments when reasonably necessary to investigate suspected fraud, disputed transactions, or violations of these Terms & Conditions.

Affiliates are responsible for any taxes, reporting obligations, or PayPal fees applicable to their affiliate income or payments.

6. Affiliate Marketing Guidelines

Affiliates must promote SimRuito honestly, responsibly, and in a manner that protects the reputation of our brand.

Permitted promotional activities include:

Publishing genuine product reviews, tutorials, demonstrations, and setup guides.

Creating sim racing content on YouTube, social media, blogs, forums, and personal websites.

Sharing approved affiliate links and coupon codes with relevant audiences.

Participating in sim racing communities in accordance with their rules.

Recommending SimRuito products based on genuine experience, knowledge, or relevant product information.

Affiliates must clearly disclose their affiliate relationship when promoting SimRuito products, in accordance with applicable laws and platform rules. For example: “I may earn a commission if you purchase through my link or use my coupon code.”

Affiliates must not make false, misleading, unsubstantiated, or exaggerated claims about SimRuito products, pricing, performance, availability, warranties, delivery, or customer experiences.

7. Prohibited Activities

The following activities are prohibited:

Using spam, unsolicited bulk email, automated messages, or deceptive direct messages to promote SimRuito.

Making false claims, fabricating reviews, impersonating customers, or misrepresenting a product or its performance.

Using misleading redirects, hidden links, cookie stuffing, tracking manipulation, or other fraudulent attribution methods.

Bidding on SimRuito brand terms or misspellings in paid advertising without prior written permission.

Using SimRuito trademarks, logos, or branded advertisements in a way that implies an official partnership or endorsement beyond the affiliate relationship.

Registering domains, social media accounts, or advertising profiles that impersonate SimRuito or create confusion about official ownership.

Posting affiliate codes on coupon, cashback, or deal websites where prohibited by the program or without required approval.

Offering unauthorized additional discounts, cashback, gifts, or incentives in connection with SimRuito coupon codes.

Using the affiliate program for self-referrals, artificial transactions, or purchases made primarily to generate commission.

Violating intellectual property rights, privacy rights, platform rules, or applicable laws.

Promoting illegal activities, hateful content, or other material that could reasonably damage SimRuito’s reputation.

SimRuito may review affiliate promotional activity and request the removal or correction of content that violates these guidelines.

8. Brand Assets and Intellectual Property

SimRuito grants approved affiliates a limited, non-exclusive, non-transferable, and revocable permission to use approved product images, logos, trademarks, and promotional materials solely to promote SimRuito products through the Affiliate Program.

Affiliates must not alter brand assets in misleading ways, register confusingly similar trademarks or domains, or claim ownership of SimRuito intellectual property.

All intellectual property rights remain with their respective owners. This permission ends when affiliate participation is terminated or when SimRuito requests that use cease.

9. Independent Relationship

Affiliates participate as independent parties. Nothing in the Affiliate Program creates an employment relationship, partnership, joint venture, franchise, agency, or authority to act on behalf of SimRuito.

Affiliates must not make promises, enter into agreements, incur expenses, or accept obligations on SimRuito’s behalf.

Affiliates are responsible for their own marketing costs, business expenses, taxes, and legal obligations.

10. Privacy and Data Protection

Affiliates must respect customer privacy and comply with applicable data protection, marketing, and cookie-consent requirements.

Affiliates must not collect, access, use, disclose, or share customer information without appropriate authorization and a lawful basis.

Any personal information handled through SimRuito’s website or affiliate system will be processed in accordance with applicable privacy requirements and our Privacy Policy.

11. Suspension and Termination

Affiliates may stop participating in the program by discontinuing their promotional activities and notifying SimRuito.

SimRuito may suspend or terminate an affiliate account if the affiliate:

Violates these Terms & Conditions.

Engages in fraudulent, misleading, or abusive marketing.

Damages or threatens to damage the SimRuito brand or customer relationships.

Provides false registration, tax, or payment information.

Fails to comply with applicable laws or platform rules.

Where appropriate, SimRuito may request that a violation be corrected before termination. Serious violations, including fraud, may result in immediate suspension or termination.

Upon termination, affiliates must stop using their affiliate codes, links, trademarks, and promotional materials.

Commissions associated with valid, eligible purchases before termination will be handled according to these Terms & Conditions and applicable law. SimRuito may withhold or reverse commissions associated with fraud, invalid orders, or other substantiated violations, subject to applicable law.

12. Program Changes and Availability

SimRuito may modify, suspend, or discontinue the Affiliate Program, its features, eligible products, commission rates, or coupon offers.

Where reasonably practicable, we will provide notice of material changes. Updated terms will be published on this page, together with a revised effective date.

Continued participation after updated terms take effect constitutes acceptance of the revised terms, to the extent permitted by applicable law.

13. Limitation of Liability

To the extent permitted by applicable law, SimRuito is not responsible for indirect or consequential losses arising from participation in the Affiliate Program, including lost anticipated earnings, advertising expenses, or interruptions to third-party platforms or tracking services.

Nothing in these Terms & Conditions excludes or limits liability that cannot lawfully be excluded or limited.
